Miami White Collar Crime Attorneys

What are White Collar Crimes?

The Federal Bureau of Investigation has defined white collar crime as “. . . those illegal acts which are characterized by deceit, concealment, or violation of trust and which are not dependent upon the application or threat of physical force or violence. Individuals and organizations commit these acts to obtain money, property, or services; to avoid the payment or loss of money or services; or to secure personal or business advantage.” (USDOJ, 1989, p. 3.)

It can be seen by the above definition that a white collar crime is normally seen in a professional and business environment.  Fraud, embezzlement, forgery and tax evasion are all common types of white collar crimes. Although these offenses are considered non-violent, the consequences of a conviction may still be quite severe. Many white collar crimes are actually federal offenses, and this typically means harsh mandatory minimum sentences based of federal sentencing guidelines, as well as investigations conducted by agencies with extensive resources and manpower to gather evidence, such as the FBI, SEC or IRS.
